Terms of Service for Commissioning Me

By Requesting to comission me, you agree to ALL of these terms in conditions, whether you read them or not.

     Most of us hate this official section and formality of it all, I know at least I do, but this serves a promise between me (the artist) and you (the client). This protects me from potentially problematic clients, scams, and harmful intentions with my artwork. This also protects you by informing you of my standards, boundaries, and lets you know what you can ask of me ahead of time. All formalities aside, I am glad you are considering working with me and I can't wait to hear what you have in mind <3

If some wordings seem harsh in nature, trust me, they are not meant to be. They are worded such a way to convey my TOS as directly as possible. 0 hidden intentions, as frankly as I could write them.

1.  General Terms
  • My Prices are subject to change with time & demand.
     

  • I have the right to reject your request for any reason.
     

  • I have the right cancel your commission if I see fit in the case that; I am disrespected, you (the client) give off red flags, or if I determine that you are trying to break or bypass my TOS.
     

  • My prices are somewhat flexible depending on your budget, but I will NOT work for less than I am comfortable with.
     

  • If there is a problem, contact me first. Don't jump the gun and pull some shady stuff or you WILL be blacklisted.
     

  • Do NOT lie about your age to receive an 18+ NSFW commission. If at any time I am suspicious of you age, I reserve the right to require proof of you age (such as some form of identification) or cancel your commission. If I discover you falsified your age for an NSFW commission, you WILL be blacklisted and put on a publicly shared list.

2.  Payment
  • I accept payments only through cashapp, Ko-fi, or Paypal.
     

  • Commissions can either be paid upfront or 50/50. Half Paid upon agreement and half paid after the sketch is complete.

3.  Process & Completion
  • The time it takes to complete your commission can vary from a few days to a month or more depending on the piece's complexity, my schedule, and potential other work in queue.

  • Once I finish your artwork, I will send you the full-resolution image (300dpi unless requested otherwise) via email, google drive, or etc. Please note that you will not receive a physical product. If you want to print your commissioned piece, I suggest contacting a third party. I am more than willing to provide you with suggestions on where to go!

4.  Revisions
  • While I am still in the sketch process, you are free to alter the artwork as much as you want until it is to your liking. Once I am done with the sketch phase I will wait for your approval before moving onto the lineart.

  • You may change the image up to 3 times during the lineart phase. Bombarding me with changes after giving me the go-ahead to start on the lineart will result in me charging a fee for the final product; unless there is a misunderstanding on my side.

  • I will not change the final product unless there is a problem on my behalf. If you changed your mind on something last minute, do not expect me to alter my finished product without an added fee.

  • I will charge a small fee if you either do not have a clear reference, have a photograph as a reference, have a written description, or anything other than a clearly drawn reference.
     

  • If there is a misunderstanding on my side, do not hesitate to bring it up or clarify. I will never charge a client for a problem on my end.

5.  Usage Rights
  • As the artist, I, Trace, reserve the right to:​​
    ​

    • Note I will NOT gain any further profit from the piece unless YOU break the TOS. (such as repurposing lineart or a sketch.)
       

    • Post the commissioned artwork online, such as on social media or in my portfolio.
       

    • Cancel and refund the order at any time for any reason​
      ​

  • You (The customer/Commissioner):
     

    • May upload your commission piece anywhere you'd like.​
       

    • May sell the artwork as part of an adoptable.
       

    • May NOT use my art for commercial purposes.
      (such as mass media or for a company, streaming on platforms such as twitch and/or youtube is perfectly okay <3)
       

  • The following is considered TOS infringement:
     

    • Reproducing my art commercially; making money off of it in any way unmentioned.
      ​

    • Claiming my artwork as your own.
       

    • Altering or tracing my artwork without my consent.
       

    • Removing my signature/logo from the piece.

6.  Cancel & Refund Policy
  • The buyer can not request a full refund once I have already started work on the piece past the sketching stage.

  • If I am unable to start or finish your commission, you will receive a full refund.

​

  • If you cancel before I start work on your commission, you may get a full refund.

​

  • DO NOT dispute a transaction for a refund, I will send the money back to you.
    (Doing so is harmful for every artist in every situation. I HIGHLY suggest you don't do this for other artists either.)

​

  • If you dispute a transaction for a refund, I will bring light to the company of our conversations and let them know that you did receive a product from me (if the commission was completed). If the commission hadn't been started and I already agreed to give you a refund, you will receive that refund and you will never hear from me again.
     

  • If you break TOS on any terms, you will be blacklisted from commissioning me again.

Well, what do I get out of all this?

Sketches and drafts that you must change or approve of before I continue work. (Time and amount vary depending on the complexity of the piece)

Insight and involvement during the entire process. (Time dependent on complexity)

​

A full-resolution file (dimensions vary, usually 3:5, 300DPI) of your piece.

​

Artwork of your character for you to share with everyone!
